When Joe Biden nominated Ketanji Brown Jackson to the Supreme Court, he fulfilled one of his few campaign promises. Her nomination may be a fait accompli due to the Democratic majority, but the approval process has elicited some shocking responses from her. The latest involved a refusal to take on a stand on the rights provided by the creator as written in the Declaration of Independence.

Criticisms of Jackson were initiated by Sen. Josh Hawley (R-MO) for her “alarming pattern” of ” letting child porn offenders off the hook for their appalling crimes.” Citing her “opinions, articles, interviews & speeches,” Hawley presented seven cases as evidence of what he described as an “alarming pattern when it comes to Judge Jackson’s treatment of sex offenders, especially those preying on children.”

Just as concerning is Jackson’s opinions on abortion. Pro-life advocates have described her as being radically pro-abortion, saying that her record on abortion “is so extreme that horrifying late-term abortions will again be in the news.”

In addition, Jackson’s opponents cite multiple decisions she made as a federal trial court judge that was reversed on appeal. She also has a record of being soft on crime. Though Biden chose her based on her skin color and gender, it is important to note that if confirmed, she would be the first Supreme Court justice to have served as a public defender. 

She has also been guided by her political beliefs rather than legal guidelines. Barack Obama nominated Jackson to become vice-chair of the United States Sentencing Commission in 2009. During her time on the District Court, Jackson wrote multiple decisions adverse to the positions of the Trump administration. 

During her confirmation hearing, she refused to offer an opinion on court-packing, a possibility that even liberal judges like Ruth Bader Ginsburg sitting Justice Stephen Breyer objected to. 

As a Georgetown Day School board member, she is a strong advocate of Critical Race Theory. When Sen. Ted Cruz quoted from a children’s book assigned at the school where the claim is made that white babies are born racist, Jackson admitted that she disagreed with that view. 

But the most bizarre exchange came after Sen. Marsha Blackburn (R-Tenn.) asked the judicial hopeful if she could define what a woman is. After some fumbling, she said she could not and is not a biologist. Though Blackburn’s question may seem incongruous and irrelevant to Jackson’s legal qualifications, the judge’s bizarre answer revealed the weightiness of the issue. Gender identity has legal ramifications and will become a battlefield in matters regarding education and sports. Jackson’s answer revealed an extreme agenda.

No less bizarre was her response to a written question from Sen. Ted Cruz about her “position on whether individuals possess natural rights.” She testified, “I do not hold a position on whether individuals possess natural rights.” 

 

In response, Sen. Cruz wrote on his Facebook page Facebook page , “This is stunning. The Declaration of Independence proclaims: “We hold these truths to be self-evident, that all men are created equal, that they are endowed, by their Creator, with certain unalienable Rights….”

“KBJ says she has ‘no position’ on whether this is true.”

It is doubly stunning as Jackson claims to be devoutly religious.

The confirmation hearings are expected to end on April 11.
